This page outlines the legal terms, rights, and responsibilities involved in working with Gabrie'le Eato LLC dba Eleable™. It is publicly posted so that all clients, collaborators, and visitors can review expectations and boundaries before engaging with our services.

By engaging with our brand, you agree to the current terms available at https://eleable.com/legal. This version is binding as of today’s date. We reserve the right to update our legal terms at any time. Continued engagement after changes are published constitutes agreement to the updated terms.

If you're accepted to work with Eleable™, you will also be provided with a personalized contract to review and sign before any services officially begin. This ensures alignment, mutual understanding, and legal protection for both parties.

📢 Notice at Collection (CCPA/CPRA)

We collect the categories of personal information listed below for the purposes described in this policy. We do not sell personal information and we do not share personal information for cross-context behavioral advertising as those terms are defined under the CPRA.

📂 Categories of Personal Information We Collect

• Identifiers: name, email, phone, billing/shipping address, IP address, user IDs.
• Customer Records: order history, subscriptions, invoices, limited support history.
• Commercial Information: products/services purchased or considered.
• Internet/Activity Data: cookies, device/browser type, time zone, pages viewed, referring links.
• Approximate Geolocation: general location to personalize content/analytics.
• Payment Information: processed via secure payment processors (e.g., Square). We do not store full card numbers on our servers.
• Professional/Account Info: business name, role/title if provided.
• Voluntary Content: form submissions, uploads, testimonials, comments.

Sensitive data: We generally do not seek to collect sensitive personal information. If a workflow requires limited sensitive data (e.g., tax IDs for vendor onboarding), we limit use to what is reasonably necessary to provide the requested service.

🧭 Sources, Purposes, and Retention

Sources: you (forms, emails, calls), your devices (cookies/analytics), payment processors, and, where relevant, vendors assisting our operations.

Purposes: to provide services and support; process transactions and prevent fraud; personalize and improve experiences; send service/transactional messages and, with consent where required, marketing; comply with law; protect our rights and the integrity of our services.

Retention: we retain data only as long as needed for the purposes above and to meet legal, accounting, and tax obligations. When no longer necessary, we delete or de-identify information consistent with our internal retention procedures.

We use cookies and similar technologies for functionality, performance, and analytics (e.g., Google Analytics). Manage cookies via your browser/device settings; disabling may affect features. You can learn about opting out of Google Analytics at https://tools.google.com/dlpage/gaoptout. Currently, we do not respond to browser “Do Not Track” signals.

📜 Lawful Bases & How We Use Information

We process data under one or more lawful bases: contract (to deliver services you request), consent (where required, e.g., certain marketing), legitimate interests (e.g., service improvement, security, analytics), and legal obligations.

We require written data-protection commitments (including confidentiality, use limitations, and security measures) and attempt to restrict cross-border transfers without appropriate safeguards. We may disclose information to comply with law or legal processes, to protect against harm or fraud, or in connection with a business transfer (e.g., merger, sale, reorganization).

International transfers (GDPR/UK GDPR): where applicable, we rely on recognized transfer mechanisms (e.g., Standard Contractual Clauses) and implement appropriate safeguards.

👤 Your Privacy Rights

Depending on your location, you may have rights to access, correct, delete, or export your data, and to object to or restrict certain processing, as well as to opt out of marketing. We honor applicable laws, including:

• California (CCPA/CPRA): access, deletion, correction, portability, and non-discrimination; opt-out of sale/share (we do not sell/share).
• Virginia (CDPA): access, correct, delete, portability, and opt-out of targeted advertising. Appeals: email subject “Privacy Rights Appeal.”
• GDPR/UK GDPR: transparency, access, correction, deletion, restriction, portability, objection, and the right to lodge a complaint with a supervisory authority.

Authorized agents (where permitted): you may designate an agent to submit requests on your behalf. We may request proof of authorization and verify your identity directly.

Marketing opt-out: use the unsubscribe link in non-transactional emails or email us. Transactional/service communications are required for your account or orders.

👶 Children’s Privacy

Our services are not directed to children, and we do not knowingly collect personal information from individuals under 15. If we learn that a minor under 13 (COPPA) or under 15 (our policy) has provided personal information, we will delete it. Parents/guardians may contact us for assistance.

🔒 Security Program

We maintain administrative, technical, and organizational safeguards designed to protect personal information against anticipated threats and unauthorized access, consistent with industry standards and applicable law. No system is 100% secure, but we review and update our program periodically and require incident reporting from vendors handling our data.

🔗 External Sites, Apps & Social Media

Our site may link to third-party websites, apps, or social platforms (e.g., Instagram, LinkedIn, YouTube). We are not responsible for their content or privacy practices. Review their terms and privacy policies before interacting.

🔁 Changes to This Policy

We may update this page from time to time. The “Updated” date above reflects the latest version. Continued use of our site or services after an update constitutes acceptance.

📄 Project Scope & Custom Services

• You’ll complete an intake form.
• You’ll receive a written quote or proposal.
• Once approved, the scope is binding.
• Any out-of-scope additions require a new agreement or fee.
• We communicate openly, respectfully, and with clear expectations.

Note: AI tools may support our process, but all final decisions and outputs are by Gabrie'le Eato LLC. Deliverables are provided in accordance with the approved scope.

💼 Pricing, Subscriptions & Payments

• Full payment is due before work begins unless otherwise agreed in writing.
• Custom pricing is matched to project scope.
• Subscriptions auto-renew unless canceled before renewal.
• Late payments of 7+ days may pause services and incur a $100/day fee.
• Missed payments are a breach of contract and may result in legal action.

✔️ Revisions & Final Delivery

• You have 5 calendar days to request edits.
• Revisions must be emailed and itemized within 48 hours of first draft delivery.
• Silence = acceptance.
• Additional revisions beyond scope require a new agreement or added fee.

🤝 Respect Policy

Abuse, bullying, or disrespect toward our team results in immediate termination without refund.

✅ Termination & Disassociation

• We may revoke use of any Eleable™ work upon breach or misuse.
• We may require removal of any related content violating scope or rights.
• We may end the engagement without refund for material breach or abuse.

⛔ Content Use & Takedown Rights

Eleable™ reserves the right to demand removal of any content that:

• Misuses Gab’s likeness, name, voice, or work;
• Violates agreed usage rights or scope;
• Is defamatory, deceptive, or damaging; or
• Was not approved for publication or promotion.

Takedown requests must be honored within 48 hours or legal action may be pursued.

🧐 Neurodivergent-Informed Design

We center our approach in calm, inclusive, flexible structures — especially for neurodivergent individuals. We lead with clarity and empathy.

📅 Selective Client Alignment

Not every inquiry results in a project. We reserve the right to pause, decline, or discontinue any engagement that feels misaligned.

⚖️ Legal Safeguards

• This agreement is governed by U.S. law and the laws of the State of Ohio.
• Exclusive venue and jurisdiction: state or federal courts located in Franklin County, Ohio, unless otherwise agreed in writing.
• If any provision is found invalid, the remaining provisions remain in effect.
• Clients are responsible for any tools, logins, or licenses unless otherwise agreed.

📅 Compensation, Storage & Retention

We retain data in accordance with relevant laws and business needs. When no longer necessary, we delete or de-identify information. If you promise access, passwords, files, or payment and fail to follow through, we may invoice you for delays, rescheduling, or recovery costs.

✉️ Engagement Acknowledgment

🖊️ Digital Consent: Digital signatures, emails, payment confirmations, or any written acknowledgment (including “yes,” “approved,” or “confirmed”) count as legal acceptance of this agreement.

🗣 Language of Record: This agreement is written in English and will be the controlling language. Translations or interpretations are not legally binding.

By texting, calling, emailing, submitting a form, or making a payment, you are legally accepting these terms — whether or not you sign separately. This policy is the controlling agreement unless replaced by a signed contract.

🖋️ Final Agreement

All deliverables are licensed, not sold, unless explicitly stated. Unauthorized resale, duplication, or training use of Eleable™ methods is prohibited.

Results and success are not guaranteed. While Eleable™ provides strategic and creative services with professionalism and care, outcomes depend on many factors beyond our control, including client implementation, market conditions, and third-party platforms.

No Guarantees or Endorsements: Eleable™ does not guarantee any specific result, revenue, media feature, or public endorsement. All services are provided for strategic and creative support — actual outcomes depend on your own execution, market dynamics, and effort.

GabX™ Legal Protection Notice

GabX™ is a proprietary digital platform developed, owned, and operated by Gabrie’le Eato LLC dba Eleable™. This includes—but is not limited to—the GabX™ name, platform concept, domain(s), design elements, branding, written materials, system structure, and future applications.

Although GabX™ is currently in development and not publicly accessible, it is legally active and secured in digital form. The platform is referenced and documented at: https://eleable.com/gabx-by-eleable/.

Any unauthorized use, imitation, misrepresentation, or duplication of GabX™, in part or whole, is strictly prohibited and may result in legal action. GabX™ is legally recognized as an extension of Eleable™ and is protected under applicable U.S. intellectual property laws.
